This Terms and Conditions Agreement (“Terms and Conditions”) applies to use of the Watford Miniature Railway web site (the “Site”) located at http://www.wmrshop.co.uk. By clicking “I have read, understand and agree to the Terms and Conditions”, you agree to these Terms and Conditions. If you do not agree, do not click the button and do not make any purchases.

1. Conditions of Sale, Payment Terms and Returns.

To purchase any goods and/or services on our Site, you must be at least eighteen (18) years of age. Prior to the purchase of any goods or services on our Site, you must provide Bank DetIails with the information they require to process your payment. Products will be posted/ready for collection once the payment has been made and within our processing times. Refunds can be requested by contacting us by emailing info@minirail.co.uk. Products will have to be returned unused/unopened for a full refund and the cost of returning them to us is the responsibility of the customer. The refund will be processed the day Watford Miniature Railway receive the returning product(s). These terms and conditions do not affect your statutory rights as a consumer.

2. Registration; Customer Accounts.

If an account is opened you are responsible for maintaining the confidentiality of your Account information, including your password, and for all activity that occurs under your account. You agree to notify Watford Miniature Railway immediately of any unauthorised use of your account or password, or any other breach of security. You may be held liable for losses incurred by Watford Miniature Railway or any other user of the Site due to someone else using your password or customer account. You may not use anyone else’s password or customer account at any time. You agree to provide us with accurate, current and complete information about yourself as prompted by the registration process. You may update any of your Account information by clicking on the Account button and selecting the appropriate link.

You also agree that Watford Miniature Railway may, in its sole discretion and without prior notice to you, terminate your access to the Site and your Account for any reason, including without limitation: (a) failure to pay for purchases, (b) suspected or actual copyright infringement. You agree that Watford Miniature Railway will not be liable to you or to any third party for termination of your access to the Site.

3. Methods of Payment, Credit Card Terms and Taxes.

Watford Miniature Railway uses PayPal and bank transfer to complete the payments. Watford Miniature Railway is under no circumstances responsible for any mistakes that might happen by PayPal, or the Credit Card companies that work with them or any damage you might suffer as a consequence.

You are responsible for paying any governmental taxes imposed on your purchases, including, but not limited to, sales, use or value-added taxes.

If we refund a payment, our payment processor will retain the fixed fee portion of the transaction fee. If the refund is due to your error we will deduct the fixed fee from the refund.

4. Order Acceptance Policy.

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Watford Miniature Railway reserves the right at any time after receipt of your order to accept or decline your order for any reason. Watford Miniature Railway further reserves the right any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. Your order will be deemed accepted by Watford Miniature Railway upon our delivery of products or services that you have ordered. We may require additional verifications or information before accepting any order.

5. Indemnification.

You agree to indemnify and hold harmless Watford Miniature Railway from any claim or demand, including reasonable attorneys’ fees, made by any third party arising out of or related to your violation of these Terms and Conditions.

6. Handling Complaints.

We will acknowledge the complaint within three working days and provide a likely timescale for resolving the dispute and keep the consumer informed about progress. None of the above processes affects the right of the consumer to take the matter to the Courts or any other complaints resolution body.

7. Right to change.

Share information about your brand with your customers. Describe a product, make announcements, or welcome customers to your store.

8. General

No delay or failure to take action under these Terms and Conditions shall constitute any waiver by Watford Miniature Railway of any provision of these Terms and Conditions. If any provision of these Terms and Conditions is invalid or unenforceable under applicable law, it is, to that extent, deemed enforceable to the fullest extent possible and the remaining provisions of these Terms and Conditions will continue in full force and effect. Watford Miniature Railway is located in England. English law applies to all orders, transactions and any other activities partaken on or relating to this Site.

Use of Contact Information

We collect information about users to provide users with the best possible service.

We will only use the information that we collect about users lawfully (in accordance with the Data Protection Act
1998).

We do not collect any personal information from users other than information that is knowingly and voluntarily given.

We do not sell, trade or rent users contact information to any third party for commercial or non-commercial use.

We do not use contact information to send future promotional emails unless the user gives their consent by choosing to opt-in by requesting us to do so by e-mail.

We do not store credit card details nor do we share customer details with any 3rd parties.

The user’s IP address is used to test our system and to gather broad demographic information.

We do not send random marketing emails to personal email addresses (spam).

Information from Children

No personal information will be collected from a child we know to be 16 or under.

Options for Removing User Information

The site provides users the opportunity to opt-out of receiving communications from us.

This site gives users the following options for removing their information from our database, to not receive future communications or to no longer receive our service.

The personal information which we hold will be held securely in accordance with our internal security policy and English law.

The information we hold will be accurate and up to date. Users can check the information that we hold about them. If they find any inaccuracies we will delete or correct it promptly.

What personal data we collect and why we collect it?

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Who we share your data with

We do not sell, trade or rent users contact information to any third party for commercial use. Data will only be released to third parties (e.g. the police) on request where there is a legal requirement for us to do so.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data
